01 — Acceptance

Acceptance of Terms

By accessing or using any services provided by Omson, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please discontinue use of our services.

These Terms constitute a legally binding agreement between you ("Client," "User," or "You") and Omson Pvt. Ltd. ("Omson," "We," "Us," or "Our"), a real estate company registered in Mumbai, Maharashtra, India.

These Terms apply to all services, digital platforms, property listings, consultations, and transactions facilitated by Omson — whether online, via phone, or in person.

Omson provides a comprehensive range of real estate services including:

Omson acts as an intermediary between buyers/renters and sellers/landlords. We do not own the properties listed unless expressly stated. All transactions are subject to individual agreements between the parties involved.

Property Listings & Accuracy

We make every effort to ensure that all property listings on our platform are accurate, current, and RERA compliant. However:

Every property listed through Omson is verified for RERA registration. We perform basic title and encumbrance checks, but this does not substitute independent legal due diligence.

Fees & Commission

Omson charges fees for facilitated transactions. Standard commission structures are as follows:

All fees are exclusive of GST (18%) unless stated otherwise. Commission is payable upon execution of the agreement or as specified in the mandate letter. Omson reserves the right to revise its fee structure with prior notice.

06 — Limitation of Liability

Limitation of Liability

Omson' total liability for any claim arising under these Terms shall not exceed the commission or fees paid by the Client in the specific transaction giving rise to the claim.

Omson shall not be liable for any loss arising from reliance on listing information, market fluctuations, delays in property registration, title defects not disclosed by the seller, or any dispute between buyer and seller.

We strongly recommend that all clients engage independent legal counsel and conduct thorough due diligence before completing any real estate transaction.

Either party may terminate a service engagement with 15 days' written notice. Upon termination:

Governing Law

These Terms are governed by the laws of India, including RERA (Real Estate Regulation and Development Act, 2016) and the Consumer Protection Act, 2019. Disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

We encourage all disputes to first be resolved through good-faith discussion. If unresolved within 30 days, parties may pursue mediation or arbitration under the Arbitration and Conciliation Act, 1996.

Changes to These Terms

Omson reserves the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on our website at least 14 days before they take effect. Continued use of our services constitutes acceptance.
